PROGRAMME OF REHABILITATING BLOCKS OF FLATS SITUATED IN LOCALITIES IN DISFAVOURED AREAS

Legislative framework:

  • Government Emergency Ordinance no. 125/2004 laying down special measures for rehabilitating  some blocks of flats situated in localities in disfavoured areas, approved as amended by Law no. 60/2005

Implementing authority:
The Ministry of Regional Development and Housing, by the National Investment Company.

Brief presentation:
Rehabilitation of multi-storey buildings intended for housing purposes, owned by natural/legal persons, presenting serious damage of the structural system and major flaws at the thermal and hydro-insulation system.

Programme development characteristics:

  • general characteristics:
    • based on proposals substantiated by the National Investment Company and carried out further to the requests of  local councils (that take into consideration the selection criteria provided by law), the Ministry of Regional Development and Housing elaborates annual programmes which are approved by Government Decision.
  • primary characteristics of the programme:
    • the public administration authorities in the localities situated in disfavoured areas have the obligation to analyse the situation of the existing housing stock, to identify and send, by the specialized territorial staff of the National Investment Company, proposals for including under the programme the blocks of flats whose structural system and/or thermal insulation system are seriously damaged;
    • the authorities of the public administration elaborate proposals based on the selection and rating criteria provided by law which are approved, as the case may be, by the local council, subject to the prior endorsement of the county inspectorate in constructions;
    • The National Investment Company analyses the proposals sent by local councils and submits the substantiations of annual programmes to the Ministry of Regional Development and Housing.
    • annual programmes are elaborated by the Ministry of Regional Development and Housing and are approved by Government Decision.
    • the owners or tenants of the blocks of flats included in programmes benefit from subsidies from the state budget for the expert’s report, design and execution of rehabilitation works, within the limit of the funds allocated for such purpose, provided that the associations of owners /dwellers conclude a convention with the National Investment Company in this respect for performance of activities for rehabilitating blocks of flats;
    • the owners or tenants, the legal persons, other than the local public administration authorities, who will bear a share of the expenses related to the expertise, design and execution of rehabilitation works are excepted from financing.


Beneficiaries:

Natural or legal persons who own multi-storey blocks of flats, in localities in disfavoured areas  presenting serious damage of the structural system and major flaws at the thermal and hydro-insulation system.

Purpose:
Rehabilitation of blocks of flats situated in localities in disfavoured areas.
Blocks of flats, as defined by Government Emergency Ordinance no. 125/2004, are multi-storey buildings intended for housing purposes, owned by natural/legal persons, presenting serious damage of the structural system and major flaws at the thermal/hydro-insulation system.

Disfavoured areas and the periods for which such areas are declared comply with the provisions of Government decisions implementing Government Emergency Ordinance no. 24/1998.

Objectives:
Rehabilitating certain blocks of flats situated in the localities in disfavoured areas, multi-storey blocks of flats owned by natural/legal persons, presenting obvious damage of the structural system and major flaws at the thermal and hydro-insulation system.

Financing sources:
State budget.

  • financing method:
    • the special rehabilitation measures for blocks of flats are financed from the state budget, within the limit of the funds allocated for such purpose, through the budget of the Ministry of Regional Development and Housing.
  • primary characteristics:
    • the expert’s report, design and execution of rehabilitation works for blocks of flats are subsidised from the state budget;
    • the owners or tenants of blocks of flats, other than the local public authorities, who bear a share of the expenses related to the expertise, design and execution of rehabilitation works are excepted from subsidies.


Amount of programme:
According to annual state budget laws.

Duration:
Permanent.

Development stages:

Centralization and analysis, by the National Investment Company, of the proposals sent by the local administration for including, in annual programs, the blocks of flats presenting obvious damage of the structural system and/or thermal insulation system;

Elaboration of annual programmes, by the Ministry of Regional Development and Housing, based on the proposals of the National Investment Company;

Approval of the annual programme by Government Decision, within the limit of annual budgetary provisions approved for such destination;
The expenses related to the technical  expert’s report, expert’s report on energy , the design and execution of intervention works are paid based on the payment documents elaborated on a monthly basis by "CNI" - S.A. and registered with the Ministry of Regional Development and Housing which checks and centralizes them and elaborates the substantiation note for the opening of budgetary loans.

For programme development purposes, "CNI" - S.A. fulfils the following duties, according to law:

  1. concluding the convention between "CNI" - S.A., in its capacity as programme coordinator, in accordance with the ordinance, and the associations of owners/dwellers, in their capacity as beneficiary of rehabilitation works, in accordance with article 6 of Government Emergency Ordinance no. 125/2004;
  2. technical - expert’s report and expert’s report on energy, regarding the blocks of flats;
  3. elaborating documentations and supporting them within the Technical and Economic Council of the Ministry of Regional Development and Housing, for the approval of the technical-economic indicators for intervention works;
  4. designing intervention works in the blocks of flats for which the technical and economic indicators were approved and obtaining the building authorization;
  5. organizing public procurement procedures
  6. carrying out intervention works, including the follow-up and technical supervision of works by authorized specialized staff; 
  7. acceptance upon finalization of intervention works and final acceptance; 
  8. substantiating the required funds for execution of works;
  9. justifying the use of the amounts allocated from the state budget for programme  development.
